Federal Fair Housing Act
The Federal Fair Housing Act (Title VIII of the Civil Rights Act of 1968, as amended by the Fair Housing Amendments Act of 1988) prohibits discrimination in the sale, rental, and financing of housing, and in other housing-related transactions, based on the following protected classes:

- Religion

The Fair Housing Act makes it illegal to discriminate in any aspect of selling, renting, or denying housing; setting different terms, conditions, or privileges; falsely denying housing availability; making, printing, or publishing discriminatory advertisements or statements; providing different housing services or facilities; denying access to or membership in any facility or service related to the sale or rental of housing; or coercing, intimidating, threatening, or interfering with anyone exercising a fair housing right.
Illinois Human Rights Act
The Illinois Human Rights Act (775 ILCS 5) provides additional protections beyond federal fair housing law. In addition to the federally protected classes, the Illinois Human Rights Act prohibits housing discrimination based on:
- Ancestry
- Age (40 and over)
- Marital Status
- Sexual Orientation
- Gender Identity
- Military Status (current or former members of the U.S. Armed Forces, Illinois National Guard, or any reserve component of the U.S. Armed Forces)
- Unfavorable Discharge from Military Service
- Order of Protection Status
The Illinois Human Rights Act applies to all real estate transactions in the State of Illinois, including the sale, rental, lease, sublease, assignment, or other transfer of real property, as well as the making or purchasing of loans and the provision of other financial assistance for real estate transactions.
Chicago Fair Housing Ordinance
The City of Chicago provides additional fair housing protections under the Chicago Fair Housing Ordinance (Chapter 5-8 of the Chicago Municipal Code). In addition to the protections provided by federal and state law, the Chicago Fair Housing Ordinance prohibits housing discrimination based on:
- Source of Income (including housing choice vouchers, Social Security, pensions, public assistance, and other lawful sources of income)
- Gender Identity
- Parental Status
- Housing Status

How to File a Fair Housing Complaint
If you believe you have experienced housing discrimination, you have the right to file a complaint with the appropriate government agency. Complaints may be filed at no cost, and it is illegal to retaliate against any person who files a fair housing complaint or participates in a fair housing investigation.
